1. Agreement to Terms
By accessing or using the PupBnBs platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. PupBnBs reserves the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
2. Description of Service
PupBnBs is a marketplace platform that connects dog owners ("Guests") with individuals who offer in-home dog boarding services ("Hosts"). PupBnBs facilitates bookings, payments, messaging, and reviews between Guests and Hosts. PupBnBs is not a pet care provider and does not directly provide boarding, sitting, or any other pet care services.
3. Eligibility
You must be at least 18 years old to use the Platform. By creating an account, you represent that all information you provide is accurate and complete, and that you will keep it up to date.
4. User Accounts
- You are responsible for maintaining the security of your account credentials and for all activity under your account.
- You may register as a Guest (dog owner), a Host, or both.
- You agree to provide accurate profile information, including dog details (for Guests) and property details (for Hosts).
- You must not create multiple accounts or share your account with others.
5. Bookings
5.1 Booking Process
Guests submit booking requests specifying dates, dogs, and an optional message. Hosts may accept or decline requests at their discretion. Once a Host accepts, the Guest receives a payment link. The booking is confirmed only after successful payment.
5.2 Booking Statuses
- Pending: Awaiting Host review.
- Accepted: Host has accepted; awaiting Guest payment.
- Confirmed: Payment received; stay is scheduled.
- Completed: Stay has ended.
- Declined: Host declined the request.
- Cancelled: Booking was cancelled.
5.3 Cancellations
Cancellation policies may vary. If you need to cancel a confirmed booking, contact the Host through our messaging system as soon as possible. Refund eligibility depends on timing and circumstances. PupBnBs reserves the right to mediate cancellation disputes.
6. Payments and Fees
6.1 Payment Processing
All payments are processed securely through Stripe. By making a payment, you agree to Stripe's Terms of Service.
6.2 Fee Structure
- Guest booking fee: A flat $10 booking fee plus a 3% service fee on the nightly subtotal (nightly rate x number of nights) is added and charged to the Guest at checkout.
- Host platform fee: A 5% fee is deducted from the Host's earnings on each booking.
- Founding Hosts, as designated by PupBnBs at its sole discretion, receive a reduced platform fee of 2.5% for the lifetime of their account.
- Hosts set their own nightly rates. PupBnBs does not control or influence pricing.
6.3 Host Payouts
Hosts receive payouts via Stripe Connect. Payouts are deposited to the bank account connected through Stripe, typically within 2-3 business days after a stay. Hosts are responsible for completing Stripe's onboarding and verification process.
7. Host Responsibilities
- Provide accurate and up-to-date listing information, including photos, property details, and accepted dog sizes.
- Maintain a safe, clean, and secure environment for visiting dogs.
- Respond promptly to booking requests and messages.
- Keep your availability calendar accurate to avoid booking conflicts.
- Comply with all local laws, regulations, and zoning requirements related to pet boarding in your area.
- Provide emergency veterinary care if needed and promptly notify the Guest of any issues.
- You are solely responsible for obtaining any required licenses or permits for operating a pet boarding service.
8. Guest Responsibilities
- Provide accurate and complete information about your dog(s), including breed, weight, temperament, medical conditions, medications, vaccination status, and any behavioral issues (e.g., bite history, separation anxiety, prey drive).
- Ensure your dog's vaccinations are current and disclose any known health issues.
- Provide emergency contact information and veterinarian details.
- Respect the Host's property, house rules, and dog size restrictions.
- Pick up your dog promptly at the agreed-upon check-out time.
- You are responsible for any damage caused by your dog to the Host's property.
9. Reviews
After a completed stay, Guests may leave a review and rating for the Host. Reviews must be honest, respectful, and based on your actual experience. PupBnBs reserves the right to remove reviews that contain abusive language, personal attacks, false information, or content unrelated to the booking experience.
10. Prohibited Conduct
You agree not to:
- Provide false or misleading information in your profile, listings, dog profiles, or reviews.
- Circumvent the Platform's payment system (e.g., arranging off-platform payments to avoid fees).
- Use the Platform for any unlawful purpose.
- Harass, threaten, or abuse other users.
- Knowingly bring a dog with undisclosed aggressive behavior or contagious illness to a Host's home.
- Create accounts under false identities or operate multiple accounts.
- Attempt to access other users' accounts or data without authorization.
- Scrape, crawl, or use automated means to access the Platform.
11. Limitation of Liability
PupBnBs is a marketplace platform and does not provide pet care services directly. To the fullest extent permitted by law:
- PupBnBs is not liable for any injury, illness, death, or damage to any dog or person arising from a booking arranged through the Platform.
- PupBnBs is not liable for any property damage caused by or to dogs during a stay.
- PupBnBs is not responsible for the accuracy of information provided by Guests or Hosts.
- PupBnBs does not guarantee the quality, safety, or suitability of any Host's home or any Guest's dog.
- In no event shall PupBnBs's total liability exceed the amount of fees paid by you to PupBnBs in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless PupBnBs, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.
13. Dispute Resolution
If a dispute arises between a Guest and a Host, we encourage both parties to communicate through our messaging system to reach a resolution. If you are unable to resolve the dispute, contact PupBnBs at support@pupbnbs.com and we will make reasonable efforts to mediate. Any legal disputes shall be governed by the laws of the Commonwealth of Massachusetts and resolved in the courts of Suffolk County, Massachusetts.
14. Account Termination
You may delete your account at any time through your Account Settings, provided you have no active or pending bookings. PupBnBs reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a risk to the safety of users or animals.
15. Disclaimers
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. PupBnBs does not warrant that the Platform will be uninterrupted, error-free, or secure. PupBnBs does not endorse or vet any particular Host or Guest. Users are responsible for their own due diligence before entering into a booking.
16. Intellectual Property
All content on the Platform, including the PupBnBs name, logo, design, and software, is owned by PupBnBs and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Platform without written permission. Content you upload (photos, reviews, listings) remains yours, but you grant PupBnBs a non-exclusive, worldwide license to display it on the Platform.
